Terms and Conditions

1.  Service Scope

Clark Estimating provides construction quantity takeoff and cost estimating services for sole purpose of supporting bidding and tendering process. We do not provide engineering services, architectural review, code compliance assessments, construction management or any on site construction activity. Our services are remote and pre construction in nature.

2. Client Responsibilities

The client is responsible for providing complete, accurate and current construction drawings and project documentation prior to commencement of work. Clark Estimating is not responsible for errors or omissions in estimates that result from incomplete, unclear or outdated drawings. Clients must notify us of any drawing revisions before the estimate is finalized.

3. Payment Terms

Payment for services is due prior to delivery of completed estimate unless otherwise agreed in writing. Monthly retainer clients are billed at start of each billing period. All prices are in Canadian dollars and include applicable taxes where required by Canadian law. Invoices unpaid after 15 days may be subject to 2% per month late fee.

4. Revisions

Each estimate includes number of revision rounds specified in your selected service package. Revisions must be requested within 7 calendar days of estimate delivery and must relate to original project scope. Revisions requested after this window or those resulting from client side scope changes, may be charged at our standard hourly revision rate.

5. Intellectual Property

All estimate documents produced by Clark Estimating are licensed to the client for their own bidding use. Clients may not resell, sublicense or redistribute Clark Estimating’s outputs to third parties without written consent. The methodologies, templates and proprietary tools used in our estimating process remain the intellectual property of Clark Estimating.

6. Confidentiality

Clark Estimating treats all project drawings, specifications and project information submitted by clients as confidential. We will not disclose your project details to any third party without your express written consent, except where required by Canadian law.

7. Cancellation and Refunds

If you cancel a project before our estimator has commenced work, a full refund will be issued. If work has commenced, you will be charged a pro rated fee based on the work completed. Completed and delivered estimates are non refundable unless Clark Estimating has made a material error in the estimate, in which case we will revise the estimate at no charge.

8. Limitation of Liability

Clark Estimating’s total liability to any client shall not exceed the fees paid for the specific project in question. We are not liable for any indirect, consequential or incidental damages, including but not limited to lost profits, lost bids or project cost overruns resulting from reliance on our estimates.

9. Governing Law

These Terms and Conditions are governed by the laws of Canada and the province in which Clark Estimating is registered. Any disputes arising from these terms shall be resolved in the courts of the applicable Canadian province.

10. Modifications to Terms

Clark Estimating reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our services following any update constitutes acceptance of the revised terms.
